Effective date: October 1, 2026 · Last updated: October 5, 2026
By accessing or using Privitum ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms apply to all users, including senders and recipients of messages transmitted through the Service.
Privitum is a secure voice message delivery platform that enables users to send encrypted audio messages that are permanently destroyed after a single playback. Privitum is a communications conduit only. We do not create, review, endorse, or control the content of any messages transmitted through the Service.
Privitum, its owners, officers, employees, agents, partners, subsidiaries, and affiliated entities (collectively, "Privitum Parties") are not responsible for the content of any messages sent or received through the Service. Users are solely responsible for the content they transmit. Privitum does not monitor, review, or retain message content. By design, messages are encrypted and permanently destroyed after playback. Privitum Parties expressly disclaim all liability arising from the content, legality, accuracy, or appropriateness of any message transmitted through the Service.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service to transmit any content that is unlawful, harassing, defamatory, obscene, fraudulent, or otherwise objectionable; to impersonate any person or entity; to violate any applicable local, state, national, or international law or regulation; or to transmit any unsolicited or unauthorized advertising or promotional material.
Privitum is a general-purpose secure communications tool. The Service is not marketed or warranted as compliant with any specific regulatory framework, including but not limited to HIPAA, FINRA, SEC, or attorney-client privilege requirements. Users are solely responsible for determining whether the Service meets their professional, regulatory, or compliance obligations. Nothing in these Terms or on the Privitum platform constitutes legal, medical, financial, or professional advice.
Messages transmitted through Privitum are encrypted using AES-256-GCM encryption. Audio files are permanently deleted from our storage systems immediately upon playback, or within seven (7) days if unplayed. Privitum does not retain copies of messages and cannot recover or produce message content after deletion. While we implement industry-standard security measures, no system is completely immune to security risks, and Privitum does not warrant that the Service is completely secure.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. PRIVITUM PARTIES DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PRIVITUM PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL PRIVITUM'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO PRIVITUM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless the Privitum Parties from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.
Privitum reserves the right to modify these Terms at any time. We will notify users of material changes by updating the effective date above. Continued use of the Service after any modification constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Wake County, North Carolina.
Paid plans are billed in advance on a recurring monthly basis through Stripe, our payment processor, until cancelled. You may cancel at any time from the Manage Subscription button on your Account page; cancellation takes effect at the end of your current billing period, and you keep access to your plan until then. Fees already paid are non-refundable except as described in our Refund Policy at /refunds, including a 7-day refund window for first-time subscribers. Privitum may change plan prices on notice; a price change applies from your next billing period after the notice. Privitum is operated by Privitum LLC, a North Carolina limited liability company.
Each individual account, and each paid seat on an organization plan, is licensed for use by one named individual. You may not share your login credentials or allow more than one person to use a single account. An organization's administrators may assign seats to individuals of their choosing, one individual per seat, and may reassign a seat to a different individual, for example when someone leaves the organization. To protect against unauthorized sharing, we may limit the number of devices or browser sessions that can be signed in to an account at the same time, and we may sign out sessions that exceed that limit. We may suspend or terminate accounts that we reasonably believe are shared or otherwise used in violation of this section.
